This is the “default” category for a commercial webcaster operating an internet-only service.

Annual Minimum Fee: $500 per station/channel. Services with more than 100 stations/channels pay $50,000. Due January 31, or within 45 days of a service’s initial transmission.

2012 Monthly Liability: $0.0021 per “performance.” Monthly statements of account due, regardless of liability owed.

Reports of Use: Total census of all tracks used, including actual total “performances,” due monthly.

This is the “default” category is for a commercial webcaster also operating an AM or FM service licensed by the FCC.

Annual Minimum Fee: $500 per station/channel. Services with more than 100 stations/channels pay $50,000. Due January 31, or within 45 days of a service’s initial transmission.

2012 Monthly Liability: $0.0020 per “performance.” Monthly statements of account due, regardless of liability owed.

Reports of Use: Total census of all tracks used, including actual total “performances,” due monthly. Small Broadcasters may waive reports of use with a timely annual submission of a Notice of Election and an annual waiver fee of $100 per station/channel.

This alternate category is for a commercial webcaster operating an internet-only service, and requires a timely “one time” submission of a Notice of Election form for any activity from 2009-2015.

Annual Minimum Fee: $500 per station/channel. Services with more than 100 stations/channels pay $50,000. Due January 31, or within 45 days of a service’s initial transmission.

2012 Monthly Liability: $0.0020 per “performance.” Monthly statements of account due, regardless of liability owed.

Reports of Use: Total census of all tracks used, including actual total “performances,” due monthly.

This alternate category is for a commercial webcaster, and requires a timely annual submission of a Notice of Election form prior to each January 31.

Annual Minimum Fee: $25,000. Due January 31. Small Pureplay Webcasters may pay this in quarterly installments.

2012 Monthly Liability: Transmissions through a subscription, syndicated or bundled service owe $0.0020 per “performance.” All other transmissions owe a “greater of” $0.0011 per “performance,” or 25% of all Gross Revenues. Small Pureplay Webcasters: Transmissions through a subscription, syndicated or bundled service owe $0.0020 per “performance.” All other transmissions owe a “greater of” 12% of all Gross Revenues (14% of Gross Revenues in excess of $250,000), or 7% of all Expenses. Monthly statements of account due for both Pureplay and Small Pureplay Webcasters, regardless of liability owed.

Reports of Use: Total census of all tracks used, including actual total “performances,” due monthly.

This alternate category is for a commercial webcaster (or, in the case of a Microcaster, a “hobbyist”), and requires a timely annual submission of a Notice of Election prior to each January 31, or with a service’s first owed payment.

Annual Minimum Fee: $2,000 (or $5,000, if expecting to earn in excess of $50,000 in Gross Revenues). Due January 31, or within 45 days of a service’s initial transmission. Microcasters: $500. Due January 31, or within 45 days of a service’s initial transmission.

2012 Monthly Liability: A “greater of” 10% of all Gross Revenues (12% of Gross Revenues in excess of $250,000), or 7% of all Expenses. Performances in excess of 5,000,000 ATH per month owe $0.0021 per “performance.” Monthly statements of account due, regardless of liability owed. Microcasters do not submit monthly statements of account.

Reports of Use: Total census of all tracks used, including actual total “performances,” due monthly. Microcasters may waive reports of use with a timely annual submission of a Notice of Election and an annual waiver fee of $100.
